Open Records Policy As a part of the judicial branch of government, the courts are not
subject to the Public Information Act. The content that is published on
our website is public information as described in the Public
Information Act. Other access to court case records is governed by
common law, statutory law, and court rules; and the custodian of those
records is generally the clerk of the court. Access to judicial records,
which are records other than case records, is governed by
Rule
12 of the Rules of Judicial Administration. The custodian of those
records is the clerk or justice of the court. A request to inspect or copy a
judicial record must be in writing, must include sufficient information to
identify it, and must be sent to the records custodian. Appeals from denial of
access to judicial records are filed with the specific court. Rule 12 and the
opinions interpreting it are here.
